Forms of discrimination

Direct discrimination

Type of discrimination in which a person is treated less favorably than another person in a comparable situation directly due to "distinctiveness," such as gender, age, disability, race, religion, nationality, political beliefs, union membership, ethnic origin, creed, or sexual orientation.

Indirect discrimination

Situation in which, due to gender, race, ethnic origin, nationality, religion, creed, worldview, disability, age, or sexual orientation, a person experiences or could experience unfavorable disparities or a particularly disadvantageous situation as a result of seemingly neutral provisions, applied criteria, or taken actions, unless the provision, criteria, or action is objectively justified by a legitimate goal to be achieved, and the means to achieve that goal are appropriate and necessary.
